Chadds Walk Homeowners Association Pool Rules
- The swimming facilities are for use by Chadds Walk residents who have paid their HOA dues or outside members who have paid the membership fee and their guests. Chadds Walk residents who have not paid their recreation dues MAY NOT be guests.
- Chadds Walk HOA offers “swim at your own risk” (SAOR) with no lifeguards present during the regular pool season between 9:00 AM to 9:00 PM daily. If you prefer swimming with a lifeguard present, see www.chaddswalk.org/pool.php for posted lifeguard hours. All Pool Rules apply, with or without a lifeguard being present.
- All HOA and Non-Resident members utilizing the pool are required to sign the "Waiver and Release of Liability" form and obtain an access card (HOA provides 2 per household). There is a $5 replacement fee for lost cards. This card opens the gate to the pools between 9:00 AM to 9:00 PM. This card serves two functions – a) allows access to the pools when a lifeguard is not present, and b) helps the lifeguard on duty verify you are an authorized Chadds Walk HOA member or non-resident member.
- Whether or not a lifeguard is present, children under the age of twelve (12) must be accompanied and supervised while at the pool by an individual of sufficient age and maturity to be capable of supervising the child.
- Property owners and Non-Resident Members are responsible for the behavior and rules adherence of all members of their household and any guest while on HOA property. This includes all pool areas, tennis courts, playgrounds, and parking lots.
- Non-toilet trained children must wear swimming disposable diapers while in the pool. All diaper changing will take place in the bathrooms and diapers disposed of properly. All toilet accidents occurring in the pool must be reported immediately to a lifeguard and will require an immediate 24-hour closure of the pool for chemical treatment.
- Flotation devices, approved by the lifeguard prior to placement in the water, are permitted only when the pool is not crowded. Large rafts are discouraged. Any child wearing a flotation device of any kind must always be supervised by in the pool.
- Masks, fins, snorkels, etc. are permitted only at the discretion of the lifeguard when the pool is not crowded. Only soft objects such as Nerf balls may be thrown in the pool and then only at the discretion of the lifeguard on duty.
- There will be a ten-minute safety break for each hour the lifeguard is on duty. During the safety break, the lifeguard may leave the pool area. During these periods, parents/supervisors are responsible for their children. All children under twelve years of age must remain out of the pool.
- Only one person at a time is allowed on the diving board and the area around the board must be clear while diving. Diving is only allowed in the deep end of the pool.
- Skates, skateboards, bicycles, scooters, etc. are not permitted in the pool area.
- No pets are permitted in the pool area, except during special pet events as set by HOA.
- Smoking is NOT permitted in the Chadds Walk common areas. Anyone wishing to smoke must completely leave HOA property before doing so.
- The pool telephone should be kept clear and is for emergency use only.
- No one will knowingly enter the pool while suffering from any infectious or communicable disease. Do not spit or blow nose in the pool.
- Running, pushing other swimmers into the pool, and rough or lewd behavior will not be permitted. Safety and respect for others is expected and will be strictly enforced.
- The deck area is to be kept clean. Please deposit all trash in the trash cans provided. At the end of each day, all pool trash should be disposed of in the large trash bins located in each parking lot.
- Should a member desire to host a party at the pool, additional lifeguards may be required. Contact the Pool Committee (pool@chaddswalk.org) or Nautix Pools (www.nautixpools.com) for additional information.
- Lifeguard stands are off limits to everyone except the lifeguard.
- You must get out of the water during any electrical storm. It is required that you not return to the pool for at least 30 minutes after the last sign of lightening or thunder.
- No beverages may be consumed from glass containers at any time. No other glass containers are permitted inside pool area at any time.
- Pool ladders are reserved for entering or leaving the pool, one person at a time.
- The lifeguard has the authority to enforce all pool rules while on duty. The lifeguard’s directions shall be followed promptly without argument.
Penalties
A violation of pool rules which endangers the safety of self of others or is deemed as inappropriate behavior will result in the following action:
First Offense – The violator will be ordered out of the pool for a period to be determined at the discretion of the lifeguard. The lifeguard will record the offense and will contact the Pool Manager or a Pool Committee member who will then inform the parents.
Second Offense – The violator will be suspended from the pool area for a period not to exceed a week. The lifeguard will record the offense and will contact the Pool Manager or a Pool Committee member who will then inform the parents.
Third Offense – The violator will be expelled from the pool area for the remainder of the swimming season.
Smoking is prohibited on HOA property and the no smoking rule will be strictly enforced. Anyone violating this rule will be asked to provide their name to the guard on duty or Pool Committee and leave the HOA property immediately. For the first offense, all members of the household will lose pool privileges for one week. Should there be a second violation, the homeowner will be fined $50 and all members of the household will lose all pool privileges for the remainder of the pool season and will not receive a refund of monies paid. Should anyone who has lost pool privileges be found on HOA property, the Board may file trespassing charges against that person, and issue a fine of $100 to the homeowner. (See item #5 for what constitutes HOA property).
Anyone caught in the pool area outside of normal pool hours without HOA Board approval will result in the following:
- First Offense - $100 fine and suspension of pool privileges for 30 days (if person is a minor the property owner responsible for the minor will be assessed $100 fine. If fine is not paid promptly the household will lose pool privileges until the fine is paid in full)
- Second Offense - $100 fine and all residents of household will lose use of all amenities (pool, playground, tennis courts) for remainder of calendar year.
The lifeguard’s decisions and directives are final, pending review and approval of the Pool Committee and Chadds Walk Board. A disagreement regarding conduct or enforcement of the pool rules must be appealed in writing to the Chadds Walk Board via email to: board@chaddswalk.org or by mail to the Chadds Walk HOA, P.O.
